admin-ajaxIn Ontario, Canada, there have been pervasive, incorrect rumours circulating around the internet that “… any verbal or nonverbal interaction with another person with the intent of holistically educating them or assisted (sic) them to wellness is now unlawful – unless you’re a registered psychotherapist, psychologist, MD, nurse, occupational therapist or social worker.”

Here’s another one … “From Yoga to BodyTalk, from hypnotherapy and hypnosis services to holistic education and spiritual care … your practitioner of choice must risk massive fines and jail time if they agree to treat you.”

And another … “If you practice any form of traditional, non-medical healing therapy and/or treatments or counselling, including spiritual and addictions counselling, in the Province of Ontario, your rights to do so will be severely restricted after March of this year.”

These are statements made on the internet by a particular group as if they are facts, rather than unsubstantiated opinion, however as I write this some months later in January, 2016, I note (with relief) the sun came up again this morning and the sky hasn’t yet fallen.

BACKGROUND

The real facts are that as with any state, province or country, before enacting laws in a democracy, lawmakers first hold public hearings to gather input from potentially affected, or involved, groups so the laws are balanced and fair for both practitioners and the public.

To that, in 2005-06, the province of Ontario held public hearings to seek input from interested parties regarding government plans to establish a professional regulatory College of Psychotherapists in Ontario.

The Act, which received Royal Assent in June, 2007 with a proposed 2013 date to begin operating (it was actually 2015), resolved a longstanding dispute with psychologists who claimed exclusive control over all psychological services, despite not necessarily being trained to do psychotherapy.

Moving to protect its members from being regulated, in 2011-12, NGH engaged in extensive negotiations with the Transitional Council for the Psychotherapy College using the lobbyist services of Jeffrey Lyons and Associates.

As part of the hearings, NGH’s Standards of Practice were read into official record and based on them, in all testimony of legislative intent, we received assurances that the Psychotherapy College DID NOT intend to regulate the practice of Consulting Hypnotism as defined by NGH Standards, that is … that we are motivational coaches using hypnosis.

WHO PAID FOR THAT?

NGH’s lobbying efforts were financed (in the 5 figures) by our union, the National Federation of Hypnotists, Local 104 of the Office and Professional Employees International Union (OPEIU) of the AFL-CIO (American Federation of Labor and Congress of Industrial Organizations) and CLC (Canadian Labour Congress).

The Federation of is one of the strongest unions of white collar workers in existence, comprised of nurses, physicians, chiropractors, podiatrists, consulting hypnotists, government employees, office workers … one which every hypnotic practitioner regardless of professional affiliation MUST consider joining.

ONGOING PROTECTION

Despite this, unsubstantiated opinions continued to be repeated by a group on the internet alleging the Psychotherapy College is going to prosecute hypnotists and other complementary health practitioners if not a member of the College.

In 2015, one of our Members, Ms. Robbie Spier Miller (Burlington Hypnosis Centre), a senior CI in Ontario, met the Premier at a political event and said she’d like to discuss the worrisome statements being made.

The Premier arranged a contact point for a meeting, and in August, 2015, Ms. Miller and I, as NGH’s Canadian Liaison for the Federation of Hypnotists union, met with the Premier’s Senior Health Advisor plus the Policy Advisor to the Minister of Health, at Queen’s Park, the seat of the provincial legislature.

We expressed that our Membership were concerned about the allegations of seemingly rampant planned prosecutions once the Act was passed, and although they didn’t appear common-sensical, suggested that the College wasn’t denying them in any fashion.

The Premier’s advisors indicated an awareness and appreciation of the unfounded web based allegations, accepted our 5-page brief, and suggested we also contact the College directly.

We did, and met with the Registrar of the College of Registered Psychotherapists Ontario (CRPO) personally in October, 2015.

We should mention here that although other organizations have been in touch with the College expressing similar concerns, NGH is the first professional association to request and be granted a meeting with the Registrar.

THE MEETING

The Registrar, with a background as a nurse and medical writer, also expressed an awareness of allegations circulating on the internet and addressing them, was quite emphatic about who the College is legislatively bound to approach.

First of all, she said, College regulations were put into place as a guide to their own Members, and (as reflected on their website) the College has very limited jurisdiction over people who are not Members.

Having said that, if individuals use the title “psychotherapist” (or an abbreviation), or hold themselves out as qualified to practise as a psychotherapist, or perform the controlled act of psychotherapy, if not a member of the College, there could be legal ramifications.

The College has the right, upon complaint from a member of the public, to investigate unlicensed individuals alleged to be performing the controlled act of psychotherapy, or calling themselves or what they do psychotherapy.

To that, also by their own regulations, the College may not investigate such an individual’s conduct, or hold him/her to the standards that apply to College Members. The College though also recognizes the expense of litigation and compliance with a “cease and desist” letter is preferred to prosecution when dealing with alleged infractions by unlicensed individuals.

WHAT IS THE CONTROLLED ACT OF PSYCHOTHERAPY?

In concert with the Colleges licensing psychotherapists, the Ministry of Health is the body who will determine the specific parameters of the controlled act of psychotherapy down the road, and in the meanwhile, the general definition to act as a guide is:

“… to treat, by means of psychotherapy technique delivered through a therapeutic relationship, an individual’s serious disorder of thought, cognition, mood, emotional regulation, perception or memory that may seriously impair the individual’s judgement, insight, behaviour, communication or social functioning.”

PSYCHOTHERAPY VS. COUNSELLING

There is a legislated difference between psychotherapy and counselling, and hence motivational coaching.

This is Ontario’s Health Professions Regulatory Advisory Council (HPRAC) distinction between Psychotherapy & Counselling …

“The practice of psychotherapy is distinct from both counselling, where the focus is on the provision of information, advice-giving, encouragement and instruction, and spiritual counselling, which is counselling related to religion or faith-based beliefs.” (HPRAC: New Directions, 2006; Chapter 7, Regulation of Psychotherapy, p. 208.)

The College IS NOT regulating counsellors or counselling. However, psychotherapy and counselling can at times be highly interrelated, like intervention in situations where an individual has indicated they intend to harm themselves, etc.

Another Canadian jurisdiction, Quebec, addressing the situation more directly, has indicated (by Bill 21) that there are interventions that, despite having similarities with psychotherapy, do not qualify as a psychotherapy.

Some of those listed are support meetings, support intervention, conjugal or family counselling, coaching, and crisis intervention.

We gave a copy of the Quebec regulations to the Registrar, and asked if the College would consider similarly clarifying the situation in Ontario in some manner for the complementary health professions, which they undertook to take under advisement.

PROFESSIONAL TITLES

It has been NGH’s practice for more than a decade to advise Members not to call themselves “hypnotherapists” nor call what they do “hypnotherapy.”

Supporting that is NGH legal opinion, based on prior experience, that in the event the hypnotherapist title is tested in a legal action, the courts are not expected to distinguish between “psychotherapy” and “hypnotherapy,” and may construe “hypnotherapy” to mean “psychotherapy by means of hypnosis.”

In fact, all NGH certificates are issued with the title Consulting Hypnotist, entitling Members to use the post-nominal CH after their name. You can also use one of the three other approved NGH earned titles, BCH (Board Certified), FNGH (Fellow, NGH) or DNGH (Diplomate) as post nominals.

LAST WORD

To common sense, just because someone with a web presence is of the opinion that the CRPO regulations disallow mothers to listen to their children’s troubles, or AA to counsel their members, or school guidance professionals to listen to student concerns, or even that critical incident stress management trained people cannot offer stress management in a critical incident unless a member of the College, is just nonsense.

It’s unfortunate that rumours are more exciting than fact, but as Adlai Stevenson II once quipped, “I offer my opponents a bargain: if they will stop telling lies about us, I will stop telling the truth about them.”

Remember that the official definition of Consulting Hypnotism is motivational coaching by means of hypnotism. It may also be held out to the public as teaching a self-help skill that allows normal people cope with normal problems in living.

As with any professional body, adherence to NGH’s Code of Ethics, Standards of Practice and Recommended Terminology are in place both as a guide for practitioners, and for Members’ protection.

ATTENTION ALL ALTERNATIVE & HOLISTIC HEALTH CARE PRACTITIONERS: According to Bill 171 instituted by the College of Registered Psychotherapists of Ontario, Canada, it is now UNLAWFUL for all alternative & holistic practitioners to aid or assist anyone with a “serious” condition of thought, cognition, mood, emotional regulation, perception or memory. Targeted practitioners will face fines of up to $25,000 for a first offense.

Alternative & holistic health care practitioners include: hypnotherapists, hypnotists, EFT practioners, NLP practitioners, angel & crystal therapists, Reiki & energy healing, sound healers, shamans, nutritional counselors, family therapists, addictions counselors, spiritual ministers, motivational therapy/coaching, life coaches, exercise therapists, coping skills therapists, access consciousness, bars, meditation, etc.

The College has also been granted legal power to take action against UNREGULATED people who …. engage in the treating of individuals who have serious disorders.

The law enacted today MAY eventually become law in all provinces of Canada and may filter through to the USA in months and years to come.

Please note the College will not be defining the meaning of “serious disorder” or “seriously impair” so just about everyone and anyone is a potential target.

Makes you wonder if the College will go so far as to target and fine the ‘recipient’ next. I wonder what else is possible.

Psychotherapy Act Proclaimed!

On March 31, 2015, the transitional Council was advised by the Ministry of Health and Long-Term Care (MOHLTC) that the Psychotherapy Act, 2007 would come into force on April 1, 2015, thereby creating the new College of Registered Psychotherapists and Registered Mental Health Therapists of Ontario (CRPO). In addition, Council learned that proclamation of the controlled act of psychotherapy has not been proclaimed into force at this time.

All those who have submitted applications for registration with the new College are advised that notifications regarding registration status are being sent out, via our Member Management System. Along with the notification, successful applicants will receive an invoice for their first year’s registration fee, and instructions about next steps to complete the registration process. IMPORTANT: please wait for your official invoice before attempting to pay your registration fee. If you have submitted an application and do not receive a notification in the next 2-3 weeks, this means your application is still under review. Continued…click here.

Who should register?

Anyone who uses the titles “registered psychotherapist” or “psychotherapist” (and any abbreviation or variation of these restricted titles); or
Anyone who wishes to hold him/herself out as qualified to practise as a psychotherapist in Ontario.
Members of other regulated professions may practice psychotherapy within their scope of practice, if they meet requirements set by their own college. The Psychotherapy Act restricts use of the titles “registered psychotherapist” and “psychotherapist” (including abbreviations or variations) to CRPO Members.

For established practitioners, the ‘Grandparenting’ route to registration will be available for two years – until March 31, 2017. This does not mean that such practitioners should wait until the end of the grandparenting period to apply. Rather, they should consider whether they need to be registered, and should apply as soon as it is reasonably possible to do so.

Postponement of the controlled act of psychotherapy

Many will be wondering about the implications of this postponement and why it is necessary. Given that the controlled act is very broad, it has caused many mental health service providers to see themselves as possibly involved in performing this activity, thus requiring registration with the new College. Postponement of the controlled act will allow time to develop a better understanding of its meaning and implications. In the meantime, child and youth workers, addiction counsellors and mental health workers may continue to provide services without concerns about the proposed controlled act.

Due to the high volume of emails and telephone calls we anticipate at this time, we kindly ask that you read the information above and on our Info for Applicants page at www.crpo.ca, as well as CRPO’s Registration Guide, if you have questions regarding eligibility for registration. Remember: unless you wish to use the title, “psychotherapist” (or an abbreviation), or hold yourself out as qualified to practise as a psychotherapist, or unless your employer requires you to be registered (or may do so in the foreseeable future), the choice is yours – assuming you have completed the required education & training and clinical experience. It is up to you, therefore, to decide whether or not you wish to become a Member!

A woman asks how the Psychotherapy Act will affect her personally as a Therapeutic Touch Practitioner and the Therapeutic Touch Network of Ontario Chair.

When you read the response, it sounds as if she is reassured it has nothing to do with Therapeutic Touch, and her modality is acceptable to continue practicing within the Province of Ontario as stressed in the letter from Sean Knight, Council & Outreach Coordinator, College of Registered Psychotherapists of Ontario.

The explanation below the reply from Sean Knight, explains the potential deception within the answer. It is imperative you read the entire newsletter to become better informed.

Over the last week I have been receiving emails from this group again
Wanting petitions signed and full of warnings etc.
Several of the TTNO membership have expressed confusion and concern about the new Psychotherapy Act and how it will impact them.
Would you be so kind as to send me something ,or point me in the direction ,of exactly how the new Psychotherapy Act will impact those who are practitioners of Complementary Therapies.
In particular, Therapeutic Touch.

As you can see below, CRPO staff did not clarify that right now the College cannot prosecute her and her group of Therapeutic Touch practitioners, BUT once the Controlled Act of Psychotherapy is also proclaimed, it can and likely will prosecute her and her colleagues.

We have sent Communiqués to our stakeholders in the past in response to communications from SPT (here and here), addressing the misleading information provided by this group. The archived Communiqués mention a proposed controlled act that is part of the Psychotherapy Act, but this was not proclaimed with the rest of the Act on April 1, 2015.

As you correctly indicated in your email, if a practitioner isn’t using a protected title or holding out, they don’t need to be registered, and the Psychotherapy Act would not impact their practice.

CRPO told Ms. Parrott only the bare minimum, and crafted their reply to sound as though she has nothing to be concerned about. Without the additional relevant facts about the controlled act, Ms. Parrott probably believes the legislation does not apply to the Therapeutic Touch treatments offered by her and her colleagues!

RELEVANT FACTS THE CRPO NEGLECTED TO DISCLOSE:

– The controlled act is already law, and only awaits the final formality of proclamation to become enforceable. This is the legislation that makes ALL treatment, verbal or non-verbal, an ‘act of psychotherapy’. The Psychotherapy Act, on the other hand, gives the CRPO the power to prosecute, once the controlled act is also proclaimed, anyone who engages in these acts/treatments who is not AUTHORIZED specifically by the legislation.

– The ONLY individuals authorized to communicate with another human being in Ontario for the purposes of assisting them with the bumps and bruises of life, are registered psychotherapists, psychologists, psychiatrists, nurses, medical doctors, occupational therapists and social workers.

– The Psychotherapy Act amendments have been proclaimed, except for the section on enforcement of the RHPA controlled act of psychotherapy, which is automatic the instant the controlled act itself is proclaimed.

– It did not stipulate that while Ms. Parrott and her group were not presently affected because the controlled act of psychotherapy has not yet been proclaimed, she could be prosecuted once it was, which could be any day, and therefore she was vulnerable to all future activities of the College.

AN ONGOING DECEPTION: CONTROLLED ACT TERMINOLOGY

CRPO has repeatedly stated they would not define the important terms in the legislation.

They misleadingly neglect to mention that in fact, “psychotherapy technique” and other important terms have already been defined in various dictionaries of psychology, starting in 2006 (see http://www.stoppsychotherapytakeover.ca/all-known-sources-of-definition-of-psychotherapeutic-techniques/ AND http://www.stoppsychotherapytakeover.ca/definitions-psychotherapeutic-techniques/), AND that the crafty terms ‘serious disorder’ and ‘serious impairment’ have already been defined by Canadian case law, where it could be concluded from court decisions that these terms can apply to every possible issue that is either diagnosed or DIAGNOSABLE. Please note that the CRPO did not state that Ms. Parrott and her Therapeutic Touch colleagues are ‘safe’, which is what she was apparently looking for.

The only way Ms. Parrott and her group can comply with the controlled act is to close their practices. Otherwise, they risk investigation, prosecution, imprisonment for up to one year and fines up to $25,000 for a first ‘offense’ of engaging in an act of psychotherapy, once the controlled act is proclaimed and the College can enforce it.

The results are in, and it’s unanimous, the Canadian Hypnosis Conference will be held at the Burlington Holiday Inn & Conference Centre for it’s 3rd year.  The location is favoured by many for convenience, price, parking and location.

The majority of attendees raved about the speakers, with their attention to detail and their giving nature.  There was some concern from attendees who were involved in the longer classes, as they felt they missed out on some great content shared by other presenters.  This has resulted in us changing the format for 2015.

We will be offering a Pre-Conference program with Shelley Stockwell Nicholas (details coming soon), and holding one and two hour classes all day Saturday and Sunday.  This will give the attendees maximum exposure to GREAT content from our amazing line-up of presenters.

We look forward to putting the 2015 Conference together, and seeing you in October!
